By accessing or using our website, services, and platform (“Platform”), you (“Dog Owner”) agree to be bound by these Terms & Conditions. If you do not accept these Terms, please refrain from using our services.

We reserve the right to modify these Terms & Conditions at any time. Changes will be posted on this page, and you will be notified of any material changes via email or through notices on our Platform.

2. Definitions

2.1 NeMo Training Academy (NTA)

Refers to the company providing the website, booking platform, and associated services.

2.2 Dog Owner

An individual using the NTA site to find and/or book a Dog Trainer for their dog(s).

2.3 Dog Trainer

A NeMo-accredited dog trainer listed on the NTA site.

2.4 Platform

The NTA website, including all features such as trainer listings, booking services, and any related services provided.

3. Use of the Platform

3.1 Eligibility

• Age Requirement: You must be at least 18 years old to use the Platform.
• Legal Capacity: You must have the legal capacity to enter into a binding contract.

3.2 Account Registration

• Accuracy of Information: You agree to provide accurate and complete information during registration and to update it as necessary.
• Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.3 User Conduct

You agree to:

• Use the Platform ethically and lawfully.
• Not engage in fraudulent activities or misuse the Platform.
• Not interfere with other users’ enjoyment of the Platform.

3.4 Independence

Dog Trainers listed on the Platform are independent contractors and are not employees or agents of NTA. NTA acts solely as an intermediary to facilitate bookings between Dog Owners and Dog Trainers.

4. Services Offered

4.1 Platform Role

NTA provides an online platform to connect Dog Owners with NeMo-accredited Dog Trainers for the purpose of booking dog training services.

4.2 Listings

• Searchability: Trainer listings are organized by location and are searchable by Dog Owners.
• Content: Listings include profiles, contact information, service details, availability, and pricing set by the Dog Trainers.

4.3 Booking Process

• Making a Booking: Bookings are made through the Dog Trainer’s listing page on the Platform.
• Payment: Full payment is required at the time of booking to confirm the appointment.
• Confirmation: Upon successful booking, confirmations and notifications are sent via email or other communication methods provided.

4.4 Communication

Any communication regarding services, scheduling, or other matters should be conducted through the Platform’s messaging system or directly with the Dog Trainer as provided.

5. Payment Terms and Fees

5.1 Payments

• Payment Processing: All payments are processed securely through our third-party payment processor.
• Authorization: By making a booking, you authorize NTA to charge your payment method for the total amount, including any applicable taxes or fees.

5.2 Pricing

• Setting Prices: Prices for services are set by the individual Dog Trainers and are subject to change.
• Accuracy: NTA is not responsible for any pricing discrepancies.

5.3 Refunds and Cancellations

Cancellations by Dog Owners:

• Before Payment: Cancellations are permitted if the booking has not been paid.
• After Payment: Once payment is made, cancellations and refunds are subject to the Dog Trainer’s refund policy.
• Process: To request a cancellation or refund, contact the Dog Trainer directly.

No-Shows:

• Policy: Failure to attend a scheduled training session without prior notice may result in forfeiture of the payment, as per the Dog Trainer’s policy.

Cancellations by Dog Trainers:

• Notification: If a Dog Trainer cancels a booking, you will be notified promptly.
• Options: You will have the option to reschedule or receive a full refund.

5.4 Fees

• Service Fees: NTA does not charge Dog Owners any fees beyond the cost of the services booked.
• Additional Charges: Any applicable taxes or additional fees will be disclosed during the booking process.

6. Dog Owner Obligations

6.1 Compliance

You agree to comply with all applicable laws, regulations, and guidelines when using the Platform and during interactions with Dog Trainers.

6.2 Representations and Warranties

• Dog’s Health: You represent that your dog(s) are up-to-date with vaccinations and are in good health.
• Accurate Information: You will provide accurate information about your dog(s), including any behavioral issues or special needs.

6.3 Prohibited Activities

You agree not to:

• Use the Platform for any unlawful or unauthorized purposes.
• Harass, abuse, or harm Dog Trainers or other users.
• Post or transmit any content that is defamatory, obscene, or infringes on others’ rights.

7. Limitation of Liability

7.1 NTA’s Liability

NTA is not liable for any damages or losses arising from your use of the Platform or your interactions with Dog Trainers. NTA does not provide the training services and is not responsible for the conduct of Dog Trainers.

7.2 No Guarantees

NTA does not guarantee the availability, quality, suitability, or safety of the Dog Trainers or the services they provide.

7.3 User Responsibility

You are solely responsible for your interactions with Dog Trainers and for ensuring that the services meet your needs.

8. Intellectual Property Rights

8.1 Ownership

All content on the Platform, including text, graphics, logos, and software, is owned by NTA or its licensors and is protected by intellectual property laws.

8.2 User Content

By submitting content to the Platform (e.g., reviews, feedback), you grant NTA a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and display such content in connection with the Platform.

9. Privacy Policy

10. Termination

10.1 Termination by User

You may discontinue use of the Platform at any time. To delete your account, please contact us at enquiries@nemotrainingacademy.co.uk.

10.2 Termination by NTA

We reserve the right to suspend or terminate your access to the Platform at our discretion, without notice, for any reason, including violation of these Terms & Conditions.

11. Governing Law and Jurisdiction

11.1 Applicable Law

These Terms & Conditions are governed by and construed in accordance with the laws of the United Kingdom.

11.2 Dispute Resolution

Any disputes arising out of or relating to these Terms & Conditions shall be resolved through mediation. If mediation fails, the dispute shall be submitted to arbitration before pursuing any legal proceedings.
